In 1984, Congress passed "The Funeral Rule", to protect consumers from wide spread abuse in the funeral industry. "The Funeral Rule", which is enforced by the Federal Trade Commission, makes it easier for consumers to choose only those goods and services they want. It also gives consumers the choice of where to purchase funeral products. Up until then, the consumer could only buy funeral products through a funeral home at whatever price that was set by the funeral home.
According to "The Funeral Rule", you can find out the cost of individual items whether you shop by telephone or in person. If you inquire about funeral arrangements in person, the funeral home must give you a written price list of available goods and services (General Price List). Keep in mind that when you arrange for a funeral you can buy a package of goods and services or individual items.
If you want to buy a casket for example, the funeral provider must supply a list that describes the available caskets and prices. The law states that the funeral provider may not refuse or charge a fee, to handle a casket you bought elsewhere. If they try, they are subject to a $10,000 fine per incident and it may even result in the suspension of their license to operate a funeral home.
When you select a funeral home to handle the funeral, there is a Basic Service Fee to cover the cost of doing business with the funeral home; it does not include services such as transfer of the remains, refrigeration, embalming and use of the facilities. The Basic Service Fee is a discretionary charge that ranges from hundreds to thousands of dollars.
